These terms and conditions (T&Cs) apply to all deliveries from Boutique Drinks GmbH to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or independent professional activity.

Contractual Partner

The purchase contract is concluded with Boutique Drinks GmbH, Intzestraße 32, 60314 Frankfurt am Main.

Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the [Buy/order with obligation to pay] button, you are placing a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order through an order confirmation via email immediately after receiving your order.

When ordering alcoholic beverages, the customer confirms by submitting the order that they have reached the legally required minimum age and undertakes to ensure that either they or a person authorized by them, who is of legal age, will receive the goods.

Right of Withdrawal

All our drinks are individually prepared on demand for you. The right of withdrawal as well as the return shipment is excluded according to §312g (2) BGB for the protection of the consumer.

Prices and Shipping Costs

The prices stated on the product pages are final and include sales tax and all other pricing components.

We aim to deliver “products” to you at the place of delivery requested by you within the time indicated by us at the time of your order, but we can’t guarantee firm delivery dates or times. Delivery options are set out here, although such delivery estimate information is indicative only.

In the event of cancellation the customer bears the direct cost of returns.

Availability of Products

Boutique Drinks reserves the right to accept orders for certain products only up to a maximum amount, in these cases this will be noted on the product page.

If, at the time of the order, the products ordered by the customer are not available, Boutique Drinks will inform the customer. If a product is permanently unavailable, Boutique Drinks will refrain from issuing a declaration of acceptance. In this case the contract will not be concluded. A purchase that has already been paid for by the customer will be refunded immediately.

Payment and Types of Payment

Purchase payment is due immediately upon completion of the contract.

Payments can be made according to the customer’s preference with a credit card (VISA, MasterCard and American Express),Giropay or PayPal. Boutique Drinks reserves the right to change the provided payment methods.

The customer agrees that invoices from Boutique Drinks can be transmitted electronically.

Reservation of Ownership

The delivered goods remain the property of Boutique Drinks until full payment is completed.

Delivery

Delivery is available only within Germany and Austria via DHL. The delivery time is up to 5 days (up to 7 days for Austria). Any deviations in delivery times will be noted on the respective product page. Delivery will be made using DHL's "Age Verification Service." DHL will verify the recipient’s age using an identification document if it is not clear that the recipient meets the minimum age requirement. The goods will only be handed over to the recipient personally or to a person in the household who has reached the minimum age. Alternative delivery to a neighbor, a designated location, or a parcel locker is not possible. Deliveries addressed to a Packstation will automatically be redirected to the nearest post office.

Liability

Boutique Drinks shall assume liability without restrictions for intentional damages and gross negligence, for slight negligence only for a significant breach of contractual obligations. Significant contractual obligations are those obligations whose completion is necessary to achieve the objective of the contract.

Liability for slightly negligent breach of significant contractual obligations is limited to the typically occurring contractual damage, the occurrence of which was foreseeable by Boutique Drinks at the completion of the contract under the prevailing circumstances at the time. In this case, liability for lack of economic success, loss of profit and indirect damages is excluded.

Payment

Payment can be made by credit card, Maestro, Paypal or Klarna. Boutique Drinks is entitled to change or cancel the payment provider at anytime.

Dispute Resolution

The EU Commission has created an internet platform for the online resolution of disputes. The platform serves as a contact point for out-of-court resolution of disputes related to contractual obligations arising from online purchase agreements. We are neither willing nor obligated to participate in a dispute resolution procedure before a consumer arbitration board.
